EB Games Canada General Contest Rules for prizing over $100
General Contest Rules (“Official Rules”).
These Official Rules apply to contests (each, a “Contest”) with the Approximate Retail Value of the prizing of $100 (one-hundred dollars) or more, that are sponsored and administered by Electronics Boutique Canada Inc. ("EBCI") unless there are specific contest rules associated with a particular contest (which reference such particular contest by name), in which case those specific contest rules will apply to such contest.
Contests are sponsored solely by EBCI. Reference to third parties in connection with prizes and/or third-party websites or services (“Contest Entities”) are for identification purposes only and not intended to suggest endorsement, sponsorship or affiliation by or with any such Contest Entity in terms of such Contest.
By participating or attempting to participate in a Contest governed by these Official Rules, you will be deemed to have received, understood, and agreed to be bound by these Official Rules WHICH ARE A CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING. WITHOUT LIMITATION, THIS CONTRACT INCLUDES INDEMNITIES TO THE CONTEST ENTITIES FROM YOU AND A LIMITATION OF YOUR RIGHTS AND REMEDIES.
NO PURCHASE OR PAYMENT NECESSARY TO ENTER A CONTEST OR WIN A PRIZE. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
ODDS OF WINNING WILL DEPEND ON THE TOTAL NUMBER OF ENTRIES RECEIVED. VOID WHERE PROHIBITED BY LAW. DECLARATION OF ELIGIBILITY / RELEASE OF LIABILITY / PRIZE ACCEPTANCE AGREEMENT MAY BE REQUIRED.
Unless otherwise stated, each Contest is open only to individuals who are legal resident of, and physically located in Canada, who at the time of entry have reached the age of majority in their province/territory of residence.
In the event a Contest is identified as being open to individuals who are under the age of majority, those individuals who are under the age of majority must have the consent of their parent or legal guardian to participate in the Contest in accordance with these Official Rules.
For each Contest, the following individuals are not eligible to enter: (a) employees, officers, directors, agents, and representatives of: (i) EBCI or its parents, subsidiaries or affiliates; (ii) any Contest co-sponsors or prize suppliers as may be identified by EBCI from time to time, or (iii) any and all other companies associated with the Contest, (b) household member of any of the individuals listed in (a), above, whether or not related; and (c) members of the immediate family (spouse, parent, child, sibling) of the individuals listed in (a), above.
Additional eligibility criteria may be stated from time to time. EBCI reserves the right to limit one winner per household per contest as determined in its sole discretion.
Any relevant information pertaining to a Contest, such as the start and end dates, start and end times, draw date, and details of any prizes available to be won, will be identified by EBCI at the time of the Contest by means of Contest promotional materials, website, official social networking pages, or representatives. The approximate value of any prize is available upon request during the particular Contest entry period.
No purchase is necessary to enter any Contest. Any applicable entry method will be identified at the time of a Contest by EBCI by means of Contest promotional materials, website, official social networking pages, or representatives. Entry methods may include one or several of the following:
a. X entry: To enter a Contest by means of this entry mechanism, log into your X account during the applicable entry period (note: must be a valid, public account), visit www.twitter.com/ebgamescan (the “Official X Account”) and send a tweet that tags @ebgamescan and complies with instructions provided by EBCI (e.g. use of a particular hashtag). Anyone found to use multiple Twitter accounts to enter a Contest will be ineligible and disqualified from participation in such Contest.
b. Instagram entry: To enter a Contest by means of this entry mechanism, log into your Instagram account during the applicable entry period (note: must be a valid, public account), visit https://www.instagram.com/ebgamescan (the “Official Instagram Profile”) and interact with the specified post for the intended participation in a Contest that complies with instructions provided by EBCI in said post. Anyone found to use multiple Instagram accounts to enter a Contest will be ineligible and disqualified from participation in such Contest.
c. Facebook entry: To enter a Contest by means of this entry mechanism, log into your Facebook account during the applicable entry period, visit www.facebook.com/ebgamescan (the “Official Facebook Page”) and interact with the specified post for the intended participation in a Contest that complies with instructions provided by EBCI in said post. Anyone found to use multiple Facebook accounts to enter a Contest will be ineligible and disqualified from participation in such Contest.
d. Mail-in entry: To enter a Contest by means of this entry mechanism, mail a letter during the applicable entry period with your name, address, day and evening telephone numbers, email address, age, and Contest name to Electronics Boutique Canada Inc., 8995 Airport Road, Brampton, Ontario L6T 5T2 to the attention of the Contest you are entering. Mail-In Entries must be mailed in a standard envelope with sufficient postage, must be postmarked within the entry period, and received within the entry period to be valid. Mechanical reproductions, postage-due and multiple Mail-In Entries in the postmarked envelope will not be accepted. Mail-In Entries received without a verifiable and legible return address or which do not clearly identify the Contest will be deemed incomplete and disqualified.
Although Contests may be communicated, promoted, or administered by means of a third-party social media service or site or other Contest Entity, such as Twitter, Instagram, or Facebook, no Contest is sponsored, endorsed, or administered by any Contest Entity. Any questions, comments or complaints regarding a Contest should be directed to EBCI and not to any Contest Entity. Unless otherwise stated, each Contest has a limit of one entry per person, per entry method.
Attempts made by an individual to submit multiple entries through the same entry method by using multiple or false contact information or by using multiple social media accounts may result in disqualification.
Entries generated by a script, computer programs, macro, programmed, robotic or other automated means are void and may be disqualified. Entries that are in excess of the stated limits, incomplete, illegible, corrupted, damaged, destroyed, forged, false, lost, late or misdirected, deceptive or otherwise not in compliance with these Official Rules may also be disqualified from participation in a Contest. All materials submitted become the exclusive property of EBCI and will not be returned. In the event a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to EBCI's satisfaction, the affected entry will be deemed ineligible. Illegible and/or incomplete entries and entries submitted by entrants who do not meet the eligibility requirements (including all requirements with respect to age and residence) are void.
Entrants who do not follow all of the instructions, who do not provide the required information, or who do not abide by these Official Rules or other instructions of EBCI may be disqualified from a Contest. Any determination or decision regarding disqualification from a Contest will be at EBCI’s sole and absolute discretion.
For each Contest where a winner is selected from entries received, EBCI will conduct a random draw from eligible entries received. For each prize to be awarded in the Contest, one entrant will be randomly selected as a potential winner and notified using the information provided at the time of entry. The potential winner will be contacted directly via direct message on the platform where the contest is announced and the confirmed winner’s handle may be disclosed in a story post for announcement purposes only, with no additional personal information shared to preserve anonymity. In the event any potential winner does not respond to such notification within ten (10) business days, declines a prize for any reason, or does not meet the requirements set forth in these Official Rules as determined by EBCI, the potential winner will be disqualified, the prize will be forfeited and the sponsor reserves the right in its sole discretion to select an alternate potential winner from among remaining eligible entries, or the prize may be cancelled. Where a Contest contemplates the award of multiple prizes, EBCI will first conduct draws from eligible entries for the grand prizes (from highest to lowest value) and then for the secondary prizes (from highest to lowest value). A participant in a particular Contest may not win more than one prize, and once a name is drawn for a particular contest, it will be excluded from further draws for that particular contest. To be declared a winner, a potential winner must a) correctly answer, without assistance, a time-limited, mathematical skill-testing question to be administered by EBCI, b) must be in compliance with these Official Rules, c) must sign and return, within any designated time period, a release of liability and consent to publicity form and any other documentation as reasonably required; d) may be required to provide proof of identification to confirm eligibility or to claim a prize. Once a potential winner is confirmed as a winner, prize distribution will be promptly coordinated by EBCI. Distribution of prizes is subject to a winner’s compliance with EBCI’s directions and other stated requirements.
Prizes are non-transferable, with no cash redemptions, equivalents or substitutions except at EBCI's sole and absolute discretion. Prize details and availability are subject to change and prize provider's rules and restrictions, and in the event that EBCI is unable to provide a winner with their prize, EBCI may elect, to provide a winner with the approximate value of such item in cash or award an alternate prize of comparable or greater value. All prizes are awarded "AS IS" and without warranty of any kind, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). Prize winners will be solely responsible for fees, costs or taxes associated with the prize they receive, regardless of whether it, in whole or in part, is used. Unclaimed or unused prizes will be forfeited. EBCI may but is not required to award forfeited prizes to other eligible entrants.
EBCI will not replace lost, misappropriated or unused prizes.
The odds of winning a prize in any given Contest depend on the number of eligible entries received for that Contest and on the application of any criteria used to describe how to enter the Contest.
Subject to applicable law, each winner irrevocably grants EBCI, Contest Entity and each of their licensees, and its and their successors, assigns and sub- licensees the right and permission to use their name, voice, likeness and/or biographical material for advertising, promotional and/or publicity purposes in connection with a Contest, in all forms of media and by all manners (now and hereafter known), and on and in connection with related products, services, advertising and promotional materials (now known or hereafter developed), worldwide, in perpetuity, without any obligation, notice or consideration except for the awarding of the prize to the winner (each, a “Release”). For clarity, the fact that a Release may be used for some winners and not others does not affect the enforceability of the foregoing rights and releases in regard to all winners. In the event of any conflict between any provision of a Release and any provision of these Official Rules, the provision that provides EBCI with the broadest rights and broadest protection will govern. Entrants agree not to use the logos, trademarks or other intellectual property of any EBCI, Contest Entity or any other entity referenced in these Official Rules or Contest relates materials, and further agrees not to reference a Contest in regard to any publicity and/or promotion of any commercial interest.
EBCI is not responsible for the actions of entrants in connection with a Contest, including entrants' attempts to circumvent these Official Rules or otherwise interfere with the administration, security, fairness, integrity or proper conduct of a Contest. Persons found tampering with or abusing any aspect of any Contest, or whom EBCI believes to be causing malfunction, error, disruption or damage may be disqualified. Additionally, any attempt to cheat or circumvent these Official Rules, as determined at the sole and absolute discretion of EBCI, may result in immediate disqualification of the entrant, as well as other possible consequences, including disqualification from any and all existing and future Contests. ANY ATTEMPT BY A PERSON TO DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF ANY CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, EBCI RESERVES THE RIGHT TO SEEK ALL LEGAL AND EQUITABLE REMEDIES FROM AND AGAINST ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. EBCI reserves the right, at its sole and absolute discretion, to disqualify (or terminate the prize of) any individual who is found to be, or suspected of, acting in violation of these Official Rules, or to be acting in an unsportsmanlike, obscene, immoral or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person.
By participating in a Contest, entrants agree to release, discharge and hold harmless EBCI, Contest Entities and each of their respective employees, directors, officers, suppliers, agents, sponsors, administrators, licensees and representatives (collectively the “Released Parties”) from and against any and all claims, liability, costs, losses, damages or injuries of any kind arising out of or related to entrants' participation in any Contest and/or related to any prize (including, without limitation, losses, damages or injuries to entrant's or any other person's computer equipment, mobile phone or other property, or to their persons, related to participation in the Contest; or arising out of any violation of rights of publicity or privacy; or based on any claim of infringement of intellectual property; or from any typographical, human or other error in the printing, offering, selection, operation or announcement of any Contest activity and/or prize and/or failure to strictly enforce these Official Rules). Without limiting the generality of the foregoing, entrants agree that Released Parties: have neither made nor will be in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, in connection with a Contest and/or with respect to the prize, including, without limitation, to the prize's quality or fitness for a particular purpose. Entrants agree and that EBCI shall have no responsibility or liability for discontinued prizes; human error; incorrect or inaccurate transcription of registration and/or account information; any technical malfunctions of the telephone network, computer online system, computer dating mechanism, computer equipment, software, or Internet service provider utilized by EBCI; interruption or inability to access the any website in association with a Contest, or any online service via the Internet due to hardware or software compatibility problems; any damage to participant's (or any third person's) computer, mobile device and/or its/their contents related to or resulting from any part of a Contest; any lost/delayed data transmissions, omissions, interruptions, viruses, bugs, defects; and/or any other errors or malfunctions, even if caused by the negligence of EBCI. Each entrant further agrees to indemnify and hold harmless Released Parties from and against any and all liability resulting or arising from any Contest and to release all rights to bring any claim, action or proceeding against Released Parties. EBCI is not responsible for the actions of entrants in connection with any Contest, including entrants' attempts to circumvent these Official Rules or otherwise interfere with the administration, security, fairness, integrity or proper conduct of a Contest.
As a condition of entering the Contest, each entrant gives consent for EBCI to obtain and deliver his or her name, address and other information to Contest Entities and other third parties for the purpose of administering any Contest and comply with applicable laws, regulations and rules. Any information entrants provide to EBCI may be used to communicate with entrant in relation to a Contest by electronic means or otherwise. In the event of a dispute over the identity of an online entrant, entry will be deemed submitted by the registered account holder of the e-mail address associated with the entry for the domain associated with the submitted address provided that person is eligible. Winners may be required to show proof of being the registered account holder. Registered account holder is defined as the person assigned to an e-mail address by an Internet access provider, on-line service provider or other organization responsible for assigning e-mail addresses. EBCI is not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in entrant's e-mail account to receive e- mail messages.
The laws of the province of Ontario will apply with respect to the interpretation of these Contest Rules. Entrants agree that the courts located in Toronto, Ontario, Canada will have exclusive jurisdiction in regard to any dispute related to the Contest or any matter relating thereto.
The invalidity or unenforceability of any provision of these Official Rules or the Release will not affect the validity or enforceability of any other provision. In the event that any provision of these Official Rules or the Release is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. EBCI's failure to enforce any term of these Official Rules will not constitute a waiver of that provision. When terms such as "may" are used in these Official Rules, EBCI has sole and absolute discretion. Entrants agree to waive any rights to claim ambiguity of these Official Rules. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Contest-related materials, the French version of these Official Rules, privacy policy or terms of use on the Website and/or the terms and conditions of these Official Rules, the English version of these Official Rules shall prevail, govern and control and the discrepancy will be resolved in EBCI's sole and absolute discretion.
EBCI may cancel, modify, or suspend any Contest or amend these Official Rules for any reason whatsoever. For example, if for any reason a Contest is not capable of running as originally planned, EBCI may adjust any of the dates, timeframes or other Contest particulars, or suspend or cancel the Contest. You may not amend these Official Rules in any way.
